Please take notice that the following public hearings were held by the Town of Pittsford Zoning Board of Appeals on Monday, April 17, 2006 in the Town Hall lower level meeting room, 11 South Main Street, beginning at 7:00 P.M. local time.

MEMBERS PRESENT
David Rogachefsky, Michael Rose, George Dounce, Rufus Falk and Peter Webster

MEMBERS ABSENT
Robert Shaddock and Barbara Servé

ALSO PRESENT
David Rowe, Building Inspector; Richard Williams, Attorney

ALSO ABSENT
 Karen Green, Town Board Liaison

Chairman, David Rogachefsky, called the regularly scheduled meeting of the Zoning Board of Appeals to order at approximately 7:00 p.m.

Richard Williams read the Legal Notice as published in the April 5, 2006, Wednesday edition of the Brighton Pittsford Post.

PUBLIC HEARINGS:

10 Hilltop Drive
Tax #164.10-3-7
Zoned A-Residential
Requesting relief of Code Section 185-113 C (3)
Requiring that no accessory structure shall be forward of the rear wall of the main structure.

Carrie Deglans owner of 10 Hilltop Drive outlined the reason for the location of the deck. This deck would be accessed from the kitchen so that she would only have to go out the kitchen door instead of walking back to the rear of the house to check on her two children. The location of the proposed deck to the side of the house, given the floor plan of the house, allows better access to the rear yard when her children are playing it the backyard.

Comments and questions from the board members:

  1. Was any other location looked at for this deck?
  2. This location is not an ideal place for this deck but will serve the function they need and it only needs the one variance of being forward of the rear wall of the main structure.

Dave Rowe commented that if this were an addition to the house it would not need a variance it is only because it is considered an accessory structure to the property.

Carrie Deglans stated that the floor plan of the house is not set up for a deck in any other location. There was a screened porch on the rear of the house when they moved in but they have since taken than down because it was in bad repair.

There were no additional comments from the board members or the public.
George Dounce moved to close the Public Hearing.

2192 West Jefferson Road

Zoned A- Residential
Requesting relief from Code Section 185-120 A
Requiring a 70' front setback

Randy Peabody, architect for the application and representing the homeowner of 2192 West Jefferson Road. Mr. Peabody outlined the reason for the applicant's requests for this variance. The applicants had a fire in December 2005 and since they are rebuilding the house anyways they decided to add onto the house enlarging the living room and adding a foyer entrance. Both of the additions are within the 70' front setback and when they applied for a building permit they were unaware of this requiring a variance. The contractors are just waiting for the decision of this board to start construction. The contractors would like to start tomorrow and so would the homeowner.

There were no additional comments from the board members or the public.
George Dounce moved to close the Public Hearing.

RESOLUTIONS:

There was no additional discussion from the board members.

Peter Webster moved to grant to the owners of 10 Hilltop Drive the requested area variance to allow a wooden deck to be forward of the rear wall of the main structure at the above-mentioned property.
Seconded: George Dounce
Roll Call: All Ayes

A resolution was passed granting the requested area variance to allow a wooden deck to be constructed forward of the rear wall of the main structure at the above-mentioned property. The minutes and resolution are on file in the Town Clerk's Office. Zoning Board of Appeals and property files.

2192 West Jefferson Road

Zoned A- Residential
Requesting relief from Code Section 185-120 A
Requiring a 70' front setback

Discussion:
There was no additional discussion from the board members.

Michael Rose moved to grant to the owners of 2192 West Jefferson Road the requested area variance to allow the living room and foyer additions within the front setback at the above-mentioned property.
Seconded: Rufus Falk
Roll Call: All Ayes

A resolution was passed granting the requested area variance to allow the construction of a living room and foyer addition within the 70' front setback allowing for a 59.25' front setback for the living room expansion and a 61.75' front setback for the porch and foyer addition at the above-mentioned property. The minutes and resolution are on file in the Town Clerk's Office, Zoning Board of Appeals and the property files.

OTHER 

  • REVIEW/APPROVAL OF THE MARCH 20, 2006 MINUTES
    D. Rogachefsky moved to approve the minutes with the corrections by unanimous vote.

  • POINT PERSONS FOR MAY 15, 2006 MEETING
    1. 1 Mendon Center Rd, area variance for a proposed detached garage within the 70' front setback. Barbara Servé
    2. 30 Alpine Drive, area variance for a proposed addition within the 20' side setback. Peter Webster
