Minutes of the Zoning Board meeting held in the Town Hall, lower level meeting room, 11 South Main Street, Pittsford, on January 21, 2004 and filed in the Town Clerk's office.

MEMBERS PRESENT
David Rogachefsky, Rufus Falk, Barbara Servé, George Dounce, Peter Webster and Robert Shaddock

Richard Williams Attorney,  John Higgins Town Board Liaison, David Rowe Building Inspector, Sandie Freitag Secretary for the Zoning Board of Appeals

Chairman, David Rogachefsky, called the regularly scheduled meeting of the Zoning Board of Appeals to order at approximately 7:00 p.m. He gave a summary of the procedures to be followed for each Public Hearing, how the Board would deliberate, how public input would be taken, etc. He indicated that written comments are welcome until the Public Hearings are closed.

PUBLIC HEARINGS:

6 Epping Wood Trail
Tax #178.03-3-14
Requesting Area Variances
Requesting relief from Codes Sections 185-113 C (1) & (2)
Requiring that no accessory structure shall be over 180-sq. ft. nor over 12' in height.

Richard Williams, attorney to the board, read the legal ad as published in the Brighton Pittsford Post, Wednesday edition, January 7, 2004, for 6 Epping Wood Trail.

Heinrich Fischer, acting as agent for Robert & Margaret Ormanoski, presented the application for 6 Epping Wood Trail as written. The 240-sq. ft. size of the pool house will also be used for the storing of the equipment for the pool and outdoor furniture. The height of 12' 6" could be scaled down to eliminate the height variance then the accessory structure would comply with the code of 12'. Some of the trees on the plans in the application are there now but the rest will be added in the new landscaping. Some of the plantings will be raised facing Route 64 (Mendon Road) to screen the pool from the road.

R. Falk asked if the arbor would be covered with plywood or covered in anyway.
Mr. Fischer stated that the arbor's frame would remain open.
R. Falk comments that as long as it remains open it does not need to be included with this variance.
R. Shaddock what is the time frame for completion?
Mr. Fischer stated that the time would be early spring the owners want to be swimming by July 4th.

Public Comments:
There were no comments from the public.

This is a Type II Action - no further action taken. Local matter, no SEQRA required.

Peter Webster moved to close the Public Hearing.

RESOLUTION:

Requesting Area Variances
Requesting relief from Codes Sections 185-113 C (1) & (2)
Requiring that no accessory structure shall be over 180-sq. ft. nor over 12' in height.

Discussion:
The members suggested that the accessory structure should be scaled down to the 12' height as required by code, therefore, eliminating the need for the second variance.

Rufus Falk moved to grant to the owners of 6 Epping Wood Trail the requested Area Variance to construct an oversized accessory structure on the above-mentioned property.

A resolution was passed granting the requested Area Variance to construct a pool house, which will be a 240-sq. ft. accessory structure that shall not be over 12' in height on the above-mentioned property. Completion date December 31, 2005. This accessory structure will be subject to ARB approval.

    All ayes approved the December 15, 2003 minutes.

    1. 72 North Country Club Drive, Area Variance: proposed to construct a new addition within the front and side setbacks Robert Shaddock
    2. 3300 Monroe Avenue, Pittsford Place Mall. Porcelain Inc. proposed to change the color of the signage from blue and gold to black and white. George Dounce
