Minutes of the Planning Board Meeting held in the Town Hall basement meeting room, 11 South Main Street, Pittsford, on February 10, 2003, and filed in the Town Clerk's Office

PRESENT

Bill Brizee called the meeting to order at 7:30 p.m.

Don Lasher of Buckingham Properties was present and Bill Brizee indicated resolutions were prepared. Mr. Brizee read the SEQRA findings of fact, made a motion to accept the resolution as read and Rich Palumbo seconded the motion. The Board voted to approve the SEQRA resolution granting a negative declaration.

Rich Palumbo indicated the Board was familiar with the Preliminary Site Plan resolution then he read the findings and conditions of approval. Clarification was made regarding item 25 by Rich Williams and 37 regarding stormwater drainage. Rich Palumbo made a motion to accept the resolution as amended, Bill Brizee seconded the motion and the Board granted approval. A copy of each resolution is attached.

Mr. Bob Burgdorf was present to represent the applicant.

Bill Brizee indicated the Board had reviewed the SEQRA resolution granting a negative declaration and made a motion to accept the resolution as written. Rich Palumbo seconded the motion and the Board voted to grant approval.

Mr. Brizee noted the Board was familiar with the Special Permit-Preliminary/Final Site Plan and made a motion to accept the resolution as written. Rich Palumbo seconded the motion and the Board granted it approval based upon the conditions of approval. Copies of each resolution are attached

Mr. Burgdorf was present for this application. Bill Brizee explained the Board was familiar with the resolution and made a motion to approve the resolution as written. Rich Palumbo seconded the motion and the Board granted approval based upon conditions of approval. A copy of the resolution is attached.

Clover Estates Sign
Chuck Ryan was present and noted earlier this evening the ARB approved plans for the Clover
Estates sign.

Bill Brizee made a motion to accept the Clover Estates Sign as proposed on condition that it was approved by the ARB and reviewed by the Town Board. The motion was seconded by Rich Palumbo and the Board voted to grant approval.

AUTUMN WOODS - Section 3
Preliminary Subdivision

John Stapleton indicted he reviewed the DRC comments.

There was discussion regarding when the proposed watermain would be installed. Mr. Stapleton indicated it should be concurrent with improvements in Section 3. Concern remains regarding access to the Ellsworth Property, as well as agricultural use, grading and buffering.

Martin Janda of BME represented the applicant and addressed several DRC comments. There was no additional public comment and Cary Smith closed hearing.

Mrs. Smith made motion to accept the Preliminary Site Plan/Special Permit resolution, noting the Board was familiar with the resolution. Bill Brizee seconded and the Board granted approval. A copy of the resolution is attached.

David Jefferson asked the applicant to provide a stake out in preparation for a site walk. Mr. Ryan indicated he would make the arrangements.

Talarico Subdivision

Mr. Summerhays represents the Talarico's and discussed several DRC comments and indicated a deed for the property exists.

Mr. Williams requested a copy of the deed and Mr. Brewster explained the applicant was to respond to each DRC comment in writing. Bill Brizee opened the hearing for public comment.

  • Mr. Glen Fjermedal of 10 Old Landmark expressed his concerns regarding buffering and desire to understand the DRC process.
  • Mr. Brizee explained the process relating to DRC comments and response.
  • Mr. David Bowen of 3191 East Avenue commented on the existence of deed restrictions, safety concerns and possible impact on his property.
  • Fr. Richard Kinsky resides at 3495 East Avenue indicated he is opposed to this project.
  • Seana Holtz of 133 Kilbourn noted her property backs up to the private drive and requested a copy of the1965 deed. Mrs. Holtz indicated Dr. Talarico approached the Town in 1984 to apply for subdivision and later withdrew the application.
  • Louise Epstein of 132 Kilbourn requested more information and explained it was his understanding past deed restrictions went with the land
  • Mr. Lehman of has safety concerns

 The hearing remains open.

January 13th Planning Board meeting minutes were approved by voice vote.

The hearing was adjourned at 9:15 p.m.
