Minutes of the Planning Board Meeting held in the Town Hall basement meeting room, 11 South Main Street, Pittsford, on January 28, 2002, and filed in the Town Clerk's Office

Bill Brizee called the meeting to order at 7:40 p.m.

Brendan Bystrak agent for Nazareth was present as Bill Brizee read the conditioned resolution granting Special Permit Modification Preliminary/Final Site Plan approval for the Scene Shop Addition Plan B. Mr. Brizee made a motion to accept the resolution as read, Cary Smith seconded and the Board voted to accept the resolution with none opposed. A copy of the resolution is attached. Mr. Brizee indicated the addition would be subject to final ARB approval.

Nancy Sprenkle, point person, indicated the Board reviewed the four resolutions granting negative declarations for SEQRA and four conditioned Preliminary/Final Site Plan/Special Permit resolutions and would vote on each as written. Mr. Scherzer agent for AT&T indicated he did not object to this procedure.
Nancy Sprenkle made a motion to accept each SEQRA resolution as written, Dan Mossien seconded each motion and the Board voted to approve with none opposed. Mrs. Sprenkle then motioned to accept each resolution for Special Permit/Preliminary/Final Site Plan subject to the findings of fact and conditions of approval, Mr. Mossien seconded each and the Board voted to accept each with none opposed. A copy of each resolution is attached.

Rich Palumbo indicated the Board had reviewed the SEQRA resolution and explained the fifth finding of fact was amended to read: No other structure has been identified in the area that has adequate height that might serve to meet the needs of the applicant. Rich motioned to accept the SEQRA resolution as amended, David Jefferson seconded the motion, the Board voted to issue a negative declaration pursuant to SEQRA subject to the Planning Board findings of fact. There was no opposition. Mr. Palumbo made a motion to accept the Preliminary/Final Site Plan/Special Permit resolution as written and David Jefferson seconded. The Board granted approval with none opposed and a copy of each resolution is attached.

Rich Palumbo indicated this resolution is an unlisted action pursuant to SEQRA for the Preliminary Site Plan/Special Permit. He made a motion to accept the resolution granting a negative declaration as written. David Jefferson seconded the motion and the Board voted to accept with none opposed. Rich made a motion to accept the conditioned Preliminary Site Plan/Special Permit resolution, David Jefferson seconded and the Board voted to grant approval with none opposed. A copy of each resolution is attached.

The Board took no action on this proposal. Mr. Goutos indicated that previously the Board questioned Voicestream's future plans involving Town coverage. Mr. Goutos explained if future facilities were being considered they would be stealth. He mentioned future forecasting would include shadow coverage, in vehicle coverage and residential coverage.
Rich Palumbo requested additional photo simulations including the viewshed from Rt. 96 and East Street looking north as well as from Knickerbocker Road from Rt. 96.
Mr. Goutos indicated at the centerline height at 80' for this proposal, the antenna would add an additional 3' and artificial foliage another 2'. He stated trees would be planted near the base.
David Wigg questioned the height of the initial artificial branches from the ground.
Marty Brewster questioned Voicestream's map showing possible gaps in coverage. Marty explained placement of a facility near the Mile Post School House was not an option. Mr. Goutos indicated he presenting a possible plan to the Board to provide additional insight to help with the Town's overall plan. The hearing is closed.
Tom Greiner, mentioned the south side church in Henrietta proposed a stealth application in the shape of a bell tower.
Cloverwood Senior Living Inc.

Tom Palumbo agent for Cloverwood indicated a meeting took place with several neighbors and Board members. He presented several renderings indicating buffering levels on the boundaries of this proposal explaining buffering would be heaviest on the western boundary. Mr. Palumbo indicated he is currently working with RG&E regarding an easement agreement.
Marty Brewster indicated the ARB would look at the garage side of the proposed patio homes, windows, lighting and buffering.
Mr. Premo, counsel for Dr. Stern would like Dr. Stern's architect to view the buffering plan and indicated he would like to see the RG&E agreement, too.Marty Brewster mentioned Dr. Stern was offered copies of materials from the last meeting which he declined at that time.
Dan Mossien indicated Mr. Palumbo would schedule another meeting to include Town staff, neighbors and interested parties.
Nancy Haggerty of 20 Stoney Clover expressed her concerns regarding the RG&E easement, lighting, buffering and density of the project.
Discussion continued regarding unit density, patio home placement and setbacks.
Nancy Sprenkle inquired whether units could be would be leased prior to construction and if this was a phased and Tom Palumbo indicated the patio homes are not part of a phase plan and anticipated 70% would be pre-sold.
Rich Williams indicated the Town Board in approving the amendment to the PUD approved the site plan and any deviations must go back to Town Board.
The hearing remains open.

Mr. Brizee indicated the Board received the DRC response and Mr. Palumbo excused himself from this application.
Brian Donald of Passero discussed landscaping and commented on modifications to the proposed site plan eliminating the drive isle behind the building, reducing the front driveway, removal of several parking spaces and rotation of the dumpster to allow easier access. Brian indicated a recent meeting with the ARB was favorable and ZBA is next.
David Jefferson indicated a meeting was needed with the DOT regarding the adjacent property and expressed concern regarding location of the pick-up window.
David Wigg mentioned a transition to grade appears to exist on the right side of the dumpster and Mr. Donald indicated the elevation is the same as the existing grade.
There was no public comment and the hearing was closed.
Spall Homes Subdivision (Forbes Property)

Ted Spall, Jr., 30 Grove Street, indicated an application was submitted to the ZBA requesting 8 variances. He discussed the possibility of moving the existing farmhouse to another lot and he read a letter of support from Tim Lancto dated January 2002.
The Board engaged in extensive discussion regarding the merits of leaving the existing farmhouse where it is rather than moving it to another lot.
Marty Brewser indicated the Planning Board is lead agency and commented on the need to provide an appropriate buffer between residential and agricultural properties.
Rich Williams explained the purpose of cluster development and the use of Town Law 278 is preservation of natural and scenic quality of open lands.
Bill Brizee indicated he would give ZBA the Board's opinion regarding the variances.
Mr. Spall indicated that he is applying for dedicated roadway not a private drive.
Additional discussion took place regarding setbacks, the farmhouse location, variances, a stand of mature trees and the roadway.
David Wigg inquired whether the proposed houses would be one story or larger and Ted mentioned a cape cod style would be acceptable.
There was no public comment and the hearing remains open.

Mr. Goutos indicated this application would be tabled and Voicestream would join Crown's application. The hearing remains open.
Crown Tower/Northcoast - South Wilmarth Rd.
Special Permit - Preliminary Site Plan

Tom Greiner agent for Crown met with Bill Johnson regarding this application and explained a 2 year plan indicating areas of interest is being developed. Mr. Greiner indicated application for a variance would be made to the ZBA and a copy of the submission would be given to this Board for review. The hearing is continued.
Cell Tower Issues
Mr. Scherzer discussed branch density, height and placement for the monopine at 5692 Palmyra Road.
Marty Brewster commented on the stub out plan for the tree indicating medium density branch out at 60'. Mr. Brewster requested a photo of a high density plan to help plan for correct tapering characteristics to avoid an hour glass appearance and that the ARB would review the plan.
Mr. Scherzer requested a modification be made to the previously accepted resolutions for
AT&T cell facilities on the NiMo line, NYPA lines to remove the requirement to paint the co-axial cables and Mr. Goutos asked that Voicestream's resolutions at those locations be included in the modification as well. Nancy Sprenkle made a motion to eliminate the requirement to paint the co-axial cables required in the above mentioned resolutions with the exception of the SSJ smokestack and Rich Palumbo seconded the Board voted to grant the modifications with none opposed.
Discussion took place regarding St. Bernard's Institute and Jim Bridges, architect, presented a rendering of the project indicating minor alterations to the proposed site plan and parking. It was noted the ARB approves the stone addition to the proposed building. The Planning Board agreed by vote that the minor revisions would not require a public hearing for the Final subdivision.
Marty Brewster and Nancy Sprenkle indicated neighbors should be notified regarding these changes. It was agreed that French Road residents in close proximity would be notified to allow for comment.
The hearing was adjourned at 10:30 p.m.
